Important

After a completed booking with either the deposit or payment in full, each attendee will have to sign and return the liability waiver within 14 days of the booking confirmation. Each attendee will receive barcoded tickets that will remain inactive until full payment and all contracts have been signed. There maybe additional contracts and waivers to sign when you reach Larsen Bay, Ayakulik River Camp or other destinations where workshops occur. There may other restrictions from 3rd party vendors which you release Dan M Lee Photography and partners from those restrictions and policies. 

Deposits & Refund

We request at least 50% deposit to confirm your reservation. Balance is due 120 days prior to your arrival or to the schedule displayed in the payment section of the website. A full refund (minus non-refundable deposit) is available prior to 6 months before arrival less a $1500.00 administrative fee, if the full payment is made. When canceling more than 6 months before your arrival date, your deposit is non-refundable regardless of the reason. You MUST have purchased trip insurance. All fly out trips are subject to change due to inclement weather or circumstances beyond our control. Pay over time plans are automatically collected from your credit card at the displayed schedule, if payment fails and we do not receive payment within 10 days your placement / ticket will be cancelled and all payments will be non-refundable.

Flights to Larsen Bay from Kodiak

Flights cost $260 per person with a bag limit of 50lbs in weight. Additional charges for heavier bags will cost an estimated extra 0.77c per Lb. These prices are estimated and out of our control. You will be billed this separately from this booking. Local charges will be from Island Air. Flights depart Kodiak Island at 6pm and land in Larsen Bay at 6:30pm. Return to Kodiak at the end of your visit leave at 8am and land in Kodiak Island at 8:30am. These flights are not included in your package.

Included Flights and Tours (Wilderness Workshop ONLY)

There will be one fly out to see bears at various points in Kodiak Island. A guide will always be present and included in the price. Each client will also get one boat trip to see marine life such as Orca, Finback Whales as well as sea birds and mammals. Food is included and accommodation. Read more about the workshop here. No alcohol is available in Larsen Bay. Fishing and Kayaking is available free of charge, fishing is also available on any bear fly out. All other flights are NOT included.

Credit cards incur a minimum 3% processing fee at the lodge.
Price includes: Lodging, meals, non-alcoholic beverages, guided fishing, guided wildlife viewing, wifi, hot tub, sauna, kayaks, fishing equipment, waders, boots, rain gear, processing/packaging of fish and souvenir water bottle.
Price excludes: Flights to and from Larsen Bay, Surcharge for freshwater fly-out fishing ($250 per person per day flying outside of the included 2 flyouts), Gratuities (15-20% of package price). Licenses/tags (varies, see Alaska Department of Fish & Game), Alcoholic beverages (BYO) and taxes ($5 per person per night).

Included Flights and Tours (Adventure Workshop ONLY)

Local air taxi from Kodiak Island is included in the price of the workshop, no further flights are required.

Liability Waiver Contract

1. This liability waiver (“Waiver”) is made effective on this date as signed by you as named on this form as above and between (“you”) and Dan M Lee Photography, Corp (the “Company”).

2. In exchange for booking and participating in the activities hosted and/or planned by the Company (including photography workshops, photography lessons, fly fishing, kayaking and hiking, the “Activity”), you hereby agree to release and forever discharge the Company and its affiliates, successors, assigns, officers, employees, representatives, partners, agents and anyone claiming through them (collectively, “Company Representatives”), in their individual and/or corporate capacities, from causes of action of any nature and kind, known or unknown, which you may have against the Company or any Company Representatives arising out of or relating to any injury, loss or damage of any kind to person or property that may be sustained as a result of participating in the Activity.

3. You understand that an accident or injury may occur while participating in the Activity and that participating in the Activity involves inherent risks, including risks of physical or phycological injury, pain, harm, or even death. You assume all related risks, voluntarily participate in the Activity, and understand that the Company assumes no responsibility for any damage, liability, claim, or lawsuit related thereto.

4. You understand and acknowledge that: (i) all accommodations, flights, and boat tours are provided by local vendors and not the Company, and (ii) you must have travel insurance to participate in the Activity and must provide proof of said travel insurance to the Company, before arranging/booking with the Company.

5. You hereby grant to the Company and the Company Representatives the perpetual right to use your image, likeness, name, face, or profile free of charge, in whole or in part, in any media and for any purpose in connection with any marketing and promotion activities.

6. You understand and acknowledge that any equipment you borrow, rent and/or lease is done at your own risk. The Company has no responsibility, financially or otherwise, for any such equipment, all equipment is owned by the local vendors and are responsible for the upkeep and maintenance of such equipment or items rented, borrowed for money reward or not.

7. By signing this Waiver, you hereby represent and warrant that you are in good health and can participate in the Activity, including but not limited to hiking and walking. You must provide proof that you are medically fit to participate in the Activity. Furthermore, in the event you have any heart conditions, you must provide a letter from a Board Certified Physician that you are fit to participate in the Activity.

8. You agree to indemnify the Company and Company Representatives against any and all claims, actions, lawsuits, damages, and judgements, including attorney’s fees, arising out of, or relating to your participation in the Activity. This Waiver shall not be in any way construed as an admission of the Company of any liability and/or responsibility.

9. This Waiver shall be binding upon the parties and their respective successors and assigns. Should any provision of this Waiver be held to be invalided or unenforceable, it shall not affect the validity or enforceability of any other provision.

10. This Waiver constitutes the entire agreement between the parties and supersedes any prior oral or written agreements or understandings between the parties concerning the subject matter of this Waiver. This Waiver may not be altered, amended, or modified, except by a written agreement by both parties.

11. This Waiver shall be governed by and construed in accordance with laws of the State of New York and the parties submit to the exclusive jurisdiction of the courts of the State of New York in relation to all matters pertaining to or arising out of this Waiver.
You hereby acknowledge that you are freely, knowingly, and voluntarily entering into this Waiver and have carefully read and fully understand all of the provisions herein.

Global Image Release

12. You understand that the Dan M Lee Photography, Corp may take photos and/or videos of program participants during program activities and events for use in educational or promotional materials in print, multimedia, or web form. 

Photos/videos will only be used for purposes related to these activities and their related partners. You also release any image rights, and dissolve Dan M Lee Photography, Corp to use images which you are or are not aware of being taken to support business promotion, marketing online or printed anywhere in the world. 

Images can also be used by partners, marketing partners and agents promoting the business online or in print. You agree to release any image rights globally in perpetuity. Including retweets, Instagram shares and any other form of social media where our tours or workshops are tagged.

I (“Participant”) authorize Dan M Lee Photography, Corp (“DMLP”), acting through its agents, employees, or representatives, to take photographs, video recordings, and/or audio recordings of me, including my name, my image, my likeness, my performance, and/or my voice (“Recordings”). I also grant DMLP an unlimited right to reproduce, use, exhibit, display, perform, broadcast, create derivative works from, and distribute the Recordings in any manner or media now existing or hereafter developed, in perpetuity, throughout the world. I agree that the Recordings may be used by DMLP, including its assigns and transferees, for any purpose, including but not limited to, marketing, advertising, publicity, or other promotional purposes. I agree that DMLP will have final editorial authority over the use of the Recordings, and I waive any right to inspect or approve of any future use of the Recordings.

I acknowledge that I am not expecting to receive compensation for participating in the Recordings or for any future use of the Recordings. I release and fully discharge DMLP, and its employees, agents, and representatives, from any claim, damages, or liability arising from or related to my participation in the Recordings or DMLP’s future use of the Recordings.

I hereby waive and release, and agree to indemnify, hold harmless and forever discharge WILD AYAKULIK LLC and its agents, employees, officers, directors, owners, affiliates, contractors, successors, and assigns, of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my stay, including my involvement or participation in any of the events or activities conducted by or arranged by WILD AYAKULIK LLC.

2. I specifically acknowledge that my activities may include a wide range of activities such as flying, mountaineering, rafting, boating, wildlife viewing, fishing and landing in beautiful environments to the access the mountains, rivers, lakes, streams, bays and unique accessible areas used by WILD AYAKULIK LLC. I acknowledge that these activities entail known and unanticipated risks that could result in physical or emotional injury, death, or damage to myself, to my property or to others. I expressly agree and promise to accept and assume all the risks existing in any activity, both inherent risks and those that may occur due to error or negligence.

3. I take full responsibility and waive any claims for personal injury, death, or property or other damage during my stay with WILD AYAKULIK LLC, resulting from activities including but not limited to fishing and related activities, and using the facility and its equipment in any manner. The risks associated with my stay at the camp and ancillary activities include, but are not limited to, accidents, injuries, illnesses, or death, whether caused by negligence, operator error, or equipment failure, related to fishing, rafting, boating, flying, and/or transportation to and from fishing destinations or other activities, being around wildlife, weather, aircraft accidents, slips and falls, improperly prepared food, being around firearms, negligence or misbehaviors of guides, other visitors or
participants, and/or my own negligence, inexperience, failure to understand instructions, or failure to follow the rules of WILD AYAKULIK LLC.

4. In addition, guides or others might misjudge the weather, the elements, or the terrain, and they might give inadequate warnings or instructions. This release broadly covers both risks that are explicitly listed in this release and all other risks associated with my stay and participation in WILD AYAKULIK LLC activities, even if they are not listed.

5. Release and Waiver of Rights including for Claims of Negligence. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless WILD AYAKULIK LLC and its owners, agents, and employees and partners or their decedents from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of WILD AYAKULIK LLC’s equipment or facilities, INCLUDING ANY SUCH CLAIMS THAT ALLEGE ANY THEORY OF NEGLIGENCE, INCLUDING GROSS NEGLIGENCE, OR NEGLIGENT ACTS OR OMISSIONS OFWILD AYAKULIK LLC( WILD AYAKULIK LLC being those defined in the opening paragraph).

6. Should WILD AYAKULIK LLC or anyone acting on their behalf, be required to incur attorneys fees and costs to enforce this agreement or defend against lawsuits or claims, I agree to indemnify and hold them harmless for all such fees and costs.

7. I expressly agree and acknowledge that the terms and conditions of this Release of Liability , Waiver of Claims, Assumption of Risks and Indemnity Agreement are contractual in nature and that I am signing this contract of my own free will. I expressly acknowledge that I am not under the influence of drugs or alcohol at the time of my signing of this document and that there are no other impediments or reasons why I should lack the capacity to enter into this contract with WILD AYAKULIK LLC.

8. This agreement is entered into on behalf on myself, my family, or partners, my personal representative and estate as well as anyone who might bring a claim related to or arising out of my death or injury. It is my intent that I am releasing any claims brought by a personal representative or estate, and all others, who might attempt to make a claim based on any occurrence involving myself.

9. In the event I or anyone on my behalf file a lawsuit against WILD AYAKULIK LLC, its owners, agents, or their decendents, I agree to do so solely in the Third Judicial District of the State of Alaska, and I further agree that the substantive law of Alaska shall apply in that action without regard to the conflict of law rules of that state.

I agree that if any part of this agreement/contract is found void or unenforceable, the remaining portion shall remain in full force and effect. This document is intended to be interpreted as broadly as possible. I have had sufficient opportunity to read this entire document, I have read and understood it, and I agree to be bound by its terms.
